2. The instance application for regular bail has been filed by the petitioner in connection with Paraiya P.S. Case No. 112 of 2015 instituted for the offence u/s 366(A) of the Indian Penal Code.
3. Earlier the application for regular bail of the petitioner was rejected by this Court vide order dated 20.04.2023 passed in Cr. Misc. No. 4750 of 2023.
4. In pursuance to the direction of this Court, a report with regard to the present stage of trial was called for and the same has been received dated 24.05.2024 by which, it appears that charge has not been framed as yet.
5. It is submitted by learned counsel for the petitioner
Patna High Court CR. MISC. No.30465 of 2024(3) dt.02-07-2024 2/2 that there is no hope to conclude the trial in near future and the petitioner is languishing in judicial custody since 21.07.2022. He has got no criminal antecedent.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail after framing of charge if the charge is not framed in connection with Paraiya P.S. Case No. 112 of 2015 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge III, Gaya.
