JUSTICE ARVIND SRIVASTAVA ORAL ORDER 02-03-2022 At the outset, learned counsel for the petitioners submits that petitioner no. 3, namely, Mithilesh Kumar, has been arrested during pendency of this application, and as such, he seeks permission to withdraw this application as against petitioner no. 3.

Permission is granted.

The application, thus, stands dismissed as withdrawn as against petitioner no. 3.

Heard learned counsels for the petitioners and the State.

Patna High Court CR. MISC. No.36816 of 2021(2) dt.02-03-2022 2/2 Petitioners apprehend arrest in connection with Pipra P.S. Case No. 197 of 2020 registered for the offence punishable under section 307 and other allied sections of the Indian Penal Code.

Learned counsel appearing for the petitioners submits that petitioners have been falsely implicated in this case due to enmity and dirty village politics. Similarly situated accused persons have been granted bail by this Court vide order dated 22.02.2022 passed in Cr. Misc. No. 26857 of 2021. Petitioners have no criminal antecedent. Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner nos. 1, 2, 4, 5, 6 and 7, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing personal bond to the satisfaction of Additional Chief Judicial Magistrate, VI, Supaul in connection with Pipra P.S. Case No. 197 of 2020 subject to the conditions laid down under section 438(2) Cr.P.C.
