The petitioners apprehend their arrest in connection with Nabinagar P. S. Case No. 344 of 2017 registered for the offences punishable under Sections 341, 323, 447, 385, 504/34 of the Indian Penal Code and Section 27 of the Arms Act. Allegedly, the informant had given a piece of land to Nikhil Hitech Construction Project and on the said land trucks of the said project were being parked. The petitioners being armed with lathi-danda and firearms went to the land and started firing and objected parking of the trucks and thereafter, they
Patna High Court Cr.Misc. No.17183 of 2018(2) dt.06-04-2018 2/2 abused and assaulted the informant also.
Submission is of false implication and that due to dirty village politics they have been implicated, they are members of the same family, no firearm injury has been caused to any one, the informant has also not received any injury, due to land dispute the occurrence has taken place and as such the petitioners deserve sympathetic consideration. Learned APP fairly submits that no firearm injury has been caused to anyone and the informant was simply assaulted by fists and slaps.
In the facts and circumstances stated above, the petitioners above named, in case of their arrest or surrender within four weeks from the date of receipt/production of a copy of this order, are directed to be released on bail on execution of bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M.,/concerned Court, Aurangabad in connection with Nabinagar P.
