The petitioner is apprehending her arrest in Andhramath P.S.Case No. 28 of 2016 registered for offences punishable under Sections 406, 409 and 420/34 of Indian Penal Code. It has been submitted that the alleged defalcated amount of Rs. 8, 71,000/- was withdrawn under the signature of the petitioner and deposited by the co-accused, Ramautar Das, the then headmaster of the school. The said headmaster has been granted anticipatory bail by a Co-ordinate Bench of this Court on 08.06.2017 in Cr. Misc. No. 20363 of 2017. The petitioner is a lady and had signed the cheque bonafide. The co-accused, Ramautar Das has been allowed anticipatory bail. The case of the
Patna High Court Cr.Misc. No.38054 of 2017 (2) dt.16-08-2017 2/2 petitioner stands on similar footing and so she also deserves anticipatory bail.
Learned Additional Public Prosecutor opposes the prayer for bail.
Having regard the facts and circumstances of the case, let the petitioner, above named, in the event of her arrest or surrender before the Court below within a period of six weeks, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each in connection with Andhramath P.S.Case No. 28 of 2016 to the satisfaction of Shri S.K.Rai, learned Judicial Magistrate, Jhanjharpur, Madhubani, subject to the conditions laid down under Section 438 (2) Cr.P.C.
