JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-07-2019 This is an application for grant of anticipatory bail in connection with Kochadhaman P.S. Case No. 188 of 2018, disclosing offences under Sections 363, 366A, 504, 506, 34 of the Indian Penal Code.

Allegation is of kidnapping the unmarried sister of the informant by the accused Md. Ziauddin, but later on, the girl was recovered and she disclosed the names of petitioners in her statement under Section 164 of Cr.P.C.

Submission of the learned counsel for the petitioners is that the matter has been compromised between the parties and they have filed such petition before the court below. Heard learned A.P.P. also.

Having heard both sides, in view of the facts and

No.26052 of 2019(4) dt.05-07-2019 2/2 circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioners, however, the petitioners may move before the learned court below for regular bail which will be considered by the learned court below on the materials available as well as submission as made above and considering the same, if possible, be disposed of on the same day.
