This application, for grant of anticipatory bail, arises out of Dulhin Bazar P.S. Case No. 64/17, disclosing offences under Sections 147, 148, 149, 341, 323, 324, 326, 325, 307, 379, 504 and 506 of the Indian Penal Code and section 27 of the Arms Act. Learned counsel for the petitioner drawn my attention to the First Information Report and submitted that there are seventeen persons named in the F.I.R. and allegation against the petitioner is that he and co-accused Vaskrit Mahto assaulted the informant on his head. He has drawn my attention to the injury report and submitted that there is only one injury found on the head of the informant that too simple in nature. No.43157 of 2017 (2) dt.21-09-2017 2/2 petitioner, as mentioned in para 3 of the petition, learned counsel for the petitioner has submitted that because of some dispute arising out of affairs of Shri Ram Janki Laxman Jee and Hanuman Jee Thakurbari located at village Bhadsara, Dulhin Bazar, several cases have been instituted.

Considering the nature of accusation against the petitioner, let the petitioner above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -III, Danapur, Patna, in connection with Dulhin Bazar P.S. Case No. 64/17, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bond shall be liable to be cancelled.
