JUSTICE BIRENDRA KUMAR ORAL ORDER 19-12-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 406/409/420/427 of the Indian Penal Code.

The F.I.R. named accused Sri Shambhu Shankar against whom the allegation was of negligence, which resulted in damage of the paddy, has already been allowed anticipatory bail by a coordinate Bench of this Court in Cr. Misc. No.20351 of 2016 on 27.06.2016. Petitioner is not named in the F.I.R. Submission is that identical allegation is there against the petitioner.

Considering the aforesaid fact, let the petitioner,

Patna High Court Cr.Misc. No.49409 of 2016 (2) dt.19-12-2016 2/2 above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi/Successor Court in connection with Dumra Police Station Case No.50 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
