The petitioners apprehend their arrest in Gamhariya P.S. Case No.203 of 2018 registered under Sections 366(A) and 34 of the Indian Penal Code.

The father of the victim named five persons including these petitioners and alleged that they all kidnapped his minor daughter.

The learned counsel for the petitioners submits that petitioners do not belong to the family of Mukesh Ram. Mukesh Ram is said to have enticed away the victim and Mukesh Ram solemnised marriage with victim in a temple. The informant is not an eye witness of the occurrence. Mukesh Ram is living

Considering the facts that the petitioners are not even family members of Mukesh Ram but they have been named in the F.I.R. on the basis of mere suspicion, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of Shree Nishi Kant Thakur, learned Additional Chief Judicial Magistrate, Madhepura in connection with Gamhariya P.S. Case No.203 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
