JUSTICE DINESH KUMAR SINGH ORAL ORDER 05-01-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 419,420,467,468,471 and 120B of the Indian Penal Code.
The prosecution case is that co accused Mahendra Singh filed a probate case on 27.12.2013 alleged to be executed by Pano Kuer, aunt of the informant on the basis of forged death certificate. It is alleged that the petitioner being Ward Member of the grampanchayat, facilitated the issuance of forged death certificate. It is submitted by the learned counsel for the petitioner that in probate case the informant has already entered appearance. Considering the fact that the genuineness of the alleged will will be tested in probate case, let the above named

No.4 of 2016 (2) dt.05-01-2016 2/2 petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Nawada in connection with (Kadirganj) Town Nawada P.S. Case No. 50 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
