JUSTICE ASHUTOSH KUMAR ORAL ORDER 14-10-2020 Heard Mr. Anurag Saurav, learned counsel for the petitioner and Ms. Pronoti Singh, learned APP for the State. The petitioner seeks bail in connection with Case No. 99 C of 2020 instituted for offence under Section 30 (a) of Bihar Excise Prohibition and Excise (Amendment) Act, 2018.

The petitioner is a driver of a vehicle, from where 1147.320 litres of liquor was recovered. The liquor was stored in a secret chamber inside the vehicle. Learned counsel for the petitioner submits that he had no idea that the vehicle had an internal chamber in

In fact the petitioner, who is a resident of Jharkhand used to drive bus of a school but during the lock-down period, he got unemployed. During this period, he was asked by a Transport Company of Ranchi to take the truck from Deoghar to Giridih. The petitioner had no idea that the liquor was being transported. No independent person has been made witness to the seizure, even though the seizure was made near the petrol pump.

The petitioner is a person of clean antecedent and he is in custody since 01.06.2020.

Regard being had to the afore-stated facts, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000 (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J. -II-cum-Special Judge (Excise), Jamui in connection with Case No. 99 C of 2020 .
