The only grievance of the petitioner is for expeditious disposal of Vigilance Case No.79B of 2012 by the Commissioner, Patna Municipal Corporation which remains pending since last three years.

The petitioner complains of encroachment made by the private respondent on Bailey Road which has led to the vigilance case.

Reserving my opinion as to whether or not the vigilance case lies in respect of encroachment on the public road

Patna High Court CWJC No.19173 of 2015 (2) dt.16-12-2015 since the application has been registered let the same be disposed of in accordance with law and after hearing the petitioner and the private respondent and while adjudicating the same the Commissioner would also bear in mind whether the provisions of the Bihar Municipal Act, 2007 would cover the issue.

Since the matter is pending consideration since 2012 hence an expeditious disposal preferably within a period of six months from today in the manner stipulated above would be appreciated.
