JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 04-09-2018 From the pleadings, it appears that petitioner has questioned the appointment of another candidates on the post of Shiksha Mitra. On the complaint of the petitioner, the District Superintendent of Education cum District Programme Coordinator, Madhepura has passed order staying the payment of Shiksha Mitra. The post of Shiksha Mitra was abolished and in place of Shiksha Mitra the post of Panchayat Shikshak was introduced by way of Rule 2006 and those who were working as Shiksha Mitra on 1.7.2006 were absorbed as Panchayat Shikshak by operation of the 2006 rule. The post of Shiksha Mitra ceases to exist after introduction of rule with effect from

The issue with regard to Shiksha Mitra was considered by the full bench of this court in Kalpana Rani Vs. State of Bihar & Ors. reported in 2014(2) PLJR 665 and the full bench has held out that the post of Shiksha Mitra is now a close chapter and no direction can be issued in the matter of Shiksha Mitra.

In view of the judgment of the full bench in Kalpana Rani Vs. State of Bihar & Ors. reported in 2014(2) PLJR 665, the Court does not find any merit in the writ application. Accordingly, the writ petition is dismissed.
