The petitioner is in custody in connection with Sahebganj P.S. Case No. 32 of 2019, corresponding to G.R. No. 248 of 2019, registered for the offence punishable under Sections 399, 402, 414 of the Indian Penal Code and Section 25 (1-b)a, 26, 35 of the Arms Act.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. Referring to the prosecution case learned counsel for the petitioner submits that from the possession of the petitioner motorcycle and mobile phone was seized whereas from whose possession Arms was recovered has granted bail by co-ordinate Bench of this Court. Learned counsel for the petitioner submits that petitioner is in

Patna High Court CR. MISC. No.26702 of 2019(2) dt.23-04-2019 2/2 custody since 26.1.2019.

Considering the aforesaid fact, Arms was not recovered from the conscious possession of the petitioner and he has remained in custody for nearly three months, the Court is inclined to grant bail to the petitioner. Let the petitioner named above be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Learned Sub Judge Ist Cum ACJM, Ist, West Muzaffarpur in connection with Sahebganj P.S.
