Petitioner seeks regular bail in connection with Chapra Muffasil PS Case No. 82/2021 registered for the offence punishable under Sections 272, 273, 413, 414/34 of the Indian Penal Code and Section 30(a) of Bihar Prohibition & Excise Act 2016.

The police on the basis of secret information that illicit liquor is being manufactured, proceeded towards the place of occurrence and saw that some persons were loading liquor on the motorcycle and on seeing the police party, they started to flee away, however, they were arrested. It is further alleged that the police recovered 200 litres of country made liquor from the place of occurrence.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he has falsely

Learned counsel next submits that petitioner is in custody since 28.02.2021 having no criminal antecedent and the charge-sheet has already been submitted in the matter. Regards being had to the submissions made by the parties and taking into consideration the material on record and the fact that petitioner is in custody since 28.02.2021 having no criminal antecedent and the charge-sheet has already been submitted in the matter, I am inclined to grant regular bail to the petitioner.

Accordingly, let the petitioner, MADAN MANJHI be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty-five Thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judgecum-Special Judge, Excise, Saran at Chapra in connection with Chapra Muffasil PS Case No. 82/2021.
