====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 09-10-2020 Heard learned counsel for the petitioner and the State. The petitioner, who is a lady, is apprehending arrest in connection with Parbatta P.S. Case No. 461 of 2017 for the offence under Sections 341, 323, 504, 427, 379, 506, 385/34 of the Indian Penal Code and Section 27 of the Arms Act. Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent.

Referring to the prosecution case, learned counsel for the petitioner submits that there is allegation of mischief by the petitioner and the co-accused while they were cutting banana tree, which was objected by the informant. He also submits that the allegation levelled by the informant's side is patently false and in fact the informant's side is political leader and as such the petitioner and others have been made accused in the present case.

No.23343 of 2020(2) dt.09-10-2020 2/2 Considering the fact that the petitioner is a lady and she has got no criminal antecedent and also the fact that there is no specific allegation of firing against this petitioner, the petitioner named above, in the event of arrest or surrender before the court below within one month from today, is directed to be released on bail on furnishing bail bonds of Rs.50,000/- (Rupees fifty thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Khagaria in connection with Parbatta P.S. Case No. 461 of 2017 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
