The petitioner has preferred this application for grant of regular bail in a case registered under sections 302, 323, 354, 448 and 34 of the Indian Penal Code.

As per the prosecution case, it is stated that the petitioner and others in an intoxicated condition misbehaved with the informant as also abused her and her husband. Thereafter, it is stated that the petitioner shot her husband in the chest as a result of which he died.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. The manner of occurrence is other than what has been narrated in the FIR. Other co-accused have been enlarged on bail. Charge has

Heard learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the direct allegation against the petitioner of having shot the husband of the informant in the chest as a result of which he died and the same being supported from the postmortem report, the Court is not inclined to enlarge the petitioner on bail and the application is rejected.
