1. Heard learned counsel for the petitioner and counsel appearing on behalf of the State.
2. Learned counsel for the petitioner is permitted to add the District Programme Officer (Establishment), Muzaffarpur as respondent no.6 during the course of day.
3. The issue raised in the present writ petition stands concluded by the judgment of Apex Court in the case of Mukesh & Anr. Vs. The State of Bihar & Ors. reported in (2017) 5 SCC 383.
4. In view of the above the present writ petition is disposed of with a direction to the respondents to consider the
Patna High Court CWJC No.4728 of 2010(4) dt.16-08-2018 2/2 case of the petitioner in the light of the principles laid down by the Apex Court in Mukesh & Anr. Vs. The State of Bihar & Ors (supra) and take final decision within a maximum period of 4 months from the date of receipt/production of a copy of this order.
5. With the aforesaid the writ petition stands disposed of.
