The petitioner apprehends his arrest in Sikandara P.S. Case No.192 of 2014 registered under Sections 323, 504, 420, 467 and 34 of the Indian Penal Code.

The informant, in his complaint petition, on the basis of which the present F.I.R. is lodged, has disclosed that he is an employee of Jain Mandir, Lacchuad. Subhash Singh along with Pappu Singh and Bhola Singh came and ensure him to install Vodafone Tower in his land bearing Khata No.25 Khesra No.878 and also took Rs.50,000/- but the Vodafone tower was not installed in the land of the informant.

The learned counsel for the petitioner submits that of course the petitioner is named in the F.I.R. but only allegation against the petitioner is that he was accompanied Subhash Singh

Patna High Court CR. MISC. No.28449 of 2019(2) dt.30-04-2019 2/2 who is alleged to have taken Rs.50,000/- from Ramesh Singh on the pretext of installing Vodafone Tower. Subhash Singh has already been granted anticipatory bail vide order passed on 10.07.2015 in Cr. Misc. No.23518 of 2015. The case of the petitioner stands on better footing.

Taking into consideration the facts aforesaid, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri M.K.Pandey, learned J.M. 1st Class, Jamui in connection with Sikandara P.S. Case No.192 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
