2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 30(a) and 32 of the Bihar Prohibition and Excise Act.

3. As per the prosecution case, 720 litres of illicit foreign liquor has been recovered from the seized Scorpio.

4. Learned counsel for the petitioner submits that petitioner has clean antecedent and he has falsely been implicated in the present case. Petitioner was not arrested from the spot and nothing has been recovered from the conscious possession of the petitioner.

5. Learned APP for the State has opposed the bail

6. Considering the quantity of recovery and the fact that petitioner is registered owner of the seized Scorpion from which the said recovery has been effected, the prayer for anticipatory bail of the petitioner is rejected. (Prabhat Kumar Singh, J) Shahnawaz/- U T
