The petitioners being the brother and father of the husband of the victim are apprehending their arrest in a case registered for the offences punishable under Sections 328, 302, 201/34 of the Indian Penal Code. Accusation is of killing the niece of the informant after 10 years of marriage by administering poison. It is submitted by the learned counsel for the petitioners that the thrust of accusation is against the husband of the victim, who is in custody and on conclusion of investigation the charge-sheet has been submitted under Section 306 of the Indian Penal Code. Moreover, co-accused Shanti Devi has been granted regular bail vide Cr. Misc. No.
Patna High Court Cr.Misc. No.57127 of 2015 (2) dt.18-12-2015 11348 of 2014.
Considering the aforesaid facts, let the above named petitioners be released on bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawadah in connection with Rajauli P.S. Case No. 135 of 2013, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
