JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 09-04-2018 Heard the learned counsel for the petitioner as well as the learned A.P.P. for the State.

In this application for anticipatory bail the petitioner apprehends his arrest in connection with Madhubani Town P.S. Case No. 375 of 2017 for the offences punishable under sections 384, 504, 506 and 34 of the I.P.C.

Allegedly, from mobile nos. 9262528757 and 7257080001 ransom of Rs. 5,00,000/- was demanded on the mobile of Sri Kapildeo Kamat, the Hon'ble Minister of Bihar Government from his son, the informant. From perusal of the impugned order it reveals that during investigation it has come that from mobile of the petitioner ransom has been demanded in

Patna High Court Cr.Misc. No.17237 of 2018 (2) dt.09-04-2018 2/2 presence of the petitioner.

Submission is of false implication and that all the sections are bailable except section 384 of the I.P.C., due to political rivalry this case has been lodged against the petitioner and as such he deserves sympathetic consideration. The learned A.P.P. opposes prayer for pre-arrest bail of the petitioner.

In the facts and circumstances stated above, considering that from mobile of the petitioner ransom was demanded by Sonu Kumar in presence of the petitioner and further the petitioner has got criminal antecedent also and as such I am not inclined to grant privilege of pre-arrest bail to the petitioner and accordingly his such prayer stands rejected in connection with the aforementioned case pending in the court of C.J.M. Madhubani.
