JUSTICE DINESH KUMAR SINGH ORAL ORDER 08-01-2016 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 324, 379, 504/34 of the Indian Penal Code and Section 27 of the Arms Act.

It is alleged that while the informant was returning home then co-accused Sunil Keshari assaulted with Baishaki and thereafter co-accused Ashish Keshari and this petitioner started abusing the informant and co-accused Asish Keshari resorted to fire which did not cause any injury to the informant. It is also alleged that all the accused persons assaulted with lathi and danda to the informant. The motive for the occurrence is with regard to a dispute for barricading the government land.

It is submitted by learned counsel for the petitioner that informant has received only one lacerated injury

Patna High Court Cr.Misc. No.514 of 2016 (2) dt.08-01-2016 2/2 of marginal size, simple in nature, though there is accusation that all the accused persons assaulted to the informant. There is counter version of the occurrence.

Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Buxar in connection with Dhansoi P.S. Case No. 88 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
