The petitioners seek bail in Chowk P.S. Case No. 117/2019 (Special Case No. 2798/2019), instituted for offence under Section(s) 272, 273, 34 of the Indian Penal Code read with Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

It is alleged in the written report that 150 litres of Mahua liquor has been recovered from a boat and also from the bank of river.

Learned counsel for the petitioners has submitted that petitioners have been named in this case merely on suspicion.

Patna High Court CR. MISC. No.26591 of 2019(2) dt.24-04-2019 2/2 From the seizure-list it appears that there is no recovery from conscious possession of these petitioners. Petitioners are in custody since 15.03.2019 having clean antecedent.

Considering the aforesaid facts and circumstances, prayer of the petitioners for grant of bail is allowed. Let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Patna, in connection with Chowk P.S. Case No. 117/2019 (Special Case No. 2798/2019), subject to the conditions that both the bailors shall be the close relative of the petitioners.
