Pp) ====================================================== CORAM: HONOURABLE DR. JUSTICE RAVI RANJAN ORAL ORDER 16-02-2016 Heard learned counsel for the petitioners and the State. The petitioners apprehend their arrest in a case registered for the offence punishable under Sections 406, 409, 420, 120(B) of the Indian Penal Code and Section 3 (i) (x) of the SC/ST Act.

No.51552 of 2015 (5) dt.16-02-2016 2/3 As per the allegation, Parvat Singh, who was son of the petitioner Raghuraj Singh, the Chairman of PACS, started banking services and collected money from the complainant and in the name of her two minor daughters, namely, Kumari Guddi and Kumari Khushi and also from several other persons including Dhanji Ram, Kanhaiya Ram, Suryakant Ram as stated in the complaint petition. After the death of aforesaid Parvat Singh, the other sons of Raghuraj Singh, namely, Neeraj Singh, Bhupat Singh @ Bhupati Singh and Deepak Singh (petitioners of Cr. Misc. No.51552/2015) were managing the accounts, however, subsequently, in the month of November, 2013, they closed the bank services and defalcated the amount deposited by the persons as stated in the complaint petition as on demand, they did not return it and also abused by taking caste name. As such, the complaint case was filed by the complainant.

Having regard to the facts and circumstances of the case, let the petitioners, namely, Neeraj Singh, Bhupat Singh @ Bhupati Singh, Deepak Singh and Raghuraj Singh @ Munna Singh be released on bail in the event of their arrest/surrender before the court below within a period of eight weeks from today in connection with Buxar Harijan P.S. Case No.27 of 2014, on furnishing bail bonds of Rs.10,000 (Ten Thousand Rupees) each

No.51552 of 2015 (5) dt.16-02-2016 3/3 with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Buxar subject to the conditions as laid down under sub-section (2) of Section 438 of the Code of Criminal Procedure with a further condition that the amounts deposited by the persons described in the complaint petition is calculated along with interest @ 2.5% to the satisfaction of the court below and deposited at the time of furnishing bail bonds separately in the names of the aforesaid persons including the minor daughters of the complainant who would be at liberty to withdraw the same.

However, this would be subject to the result of the criminal case and would be without prejudice to the stand which would be taken by the petitioners for his defence in the case concerned.
