At the outset, learned counsel appearing on behalf of the petitioners submits that this writ application may be disposed of in the light of statement made in the paragraph 5(B) of the counter affidavit filed by the respondent-Bank whereby it is informed that nominations have not been provided in the accounts of the petitioners and in absence of nominations, the petitioners are required to submit required documents as mentioned in paragraph 5(B) of the counter affidavit. He further
Patna High Court CWJC No.8526 of 2024(5) dt.27-07-2026 2/2 submits that a direction may be issued to respondent-Bank to pay the admissible amount of the petitioners within a reasonable time frame.
3. On the other hand, learned counsel for the respondent-Bank submits that if the petitioners submit all the documents as mentioned in paragraph 5(B) of the counter affidavit, their grievances would be redressed within a period of one month.
4. Taking into consideration the categorical stand of the respondent-Bank, this writ application is disposed of with a direction to the petitioner to submit all the required documents in terms of paragraph 5(B) of the counter affidavit within 7 days from the date of order. On being so, in turn, the respondentBank shall pay the admissible amount to the petitioners within a period of one month thereafter.
5. In the above term, the writ application is disposed of.
6. All pending interlocutory application(s), if any, stands disposed of.
