The petitioner apprehends his arrest in connection with Kudhani P.S. Case no. 134 of 2019, registered under Sections 272, 273 of the Indian Penal Code and Section 30(A)/10 of the Bihar Prohibition and Excise Act. The accusation is that on receiving the secret information about keeping the illicit liquor in the house of Suraj Sahani by Raj Kumar Sahani, Ram Kumar Sahani, Dev Kumar Sahani in village Kudhani Naya Tola, the informant along with other Police personnel reached there then saw that two persons boarding on motorcycle kept one sack on the motorcycle. On seeing the Police personnel, they started fleeing, but on chase one person was apprehended, who disclosed his name as Bhola Kumar saying that he was going to supply the liquor kept in sack to Abhishek Kumar (Petitioner).

Learned counsel for the petitioner submits that the name of the petitioner has surfaced in the confessional statement of co-accused Bhola Kumar. The petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Special Judge Excise Act, Muzaffarpur in connection with Kudhani P.S. Case No. 134 of 2019, subject to the condition as laid down under Section 438

(2) of the Cr.P.C.
