JUSTICE SHIVAJI PANDEY ORAL ORDER 05-02-2018 Heard learned counsel for the petitioner and learned counsel for the State.
In this case, the petitioner is seeking anticipatory bail in connection with Khajekalan P.S. Case No.170 of 2016, registered for the offence punishable under Section 414 of the Indian Penal Code.
Allegation has been made that two persons including the petitioner tried to flew away after seeing the police party, however, they were apprehended by the police and they told that the motorcycle on which they were riding has been stolen by Pintu Das and they are going to sell the motorcycle in Hajipur at the instruction of Pintu Das.
Looking to the nature of allegation, this Court is not
Patna High Court Cr.Misc. No.6123 of 2018 (2) dt.05-02-2018 2/2 inclined to grant anticipatory bail to the petitioner. Accordingly, the prayer for bail is rejected. However, if the petitioner surrenders before the Court below within three weeks from today and prays for regular bail, the Court below will consider the same and pass appropriate order without being influenced by the order of this Court.
