The petitioner is apprehending arrest in connection with Chainpur P.S. Case No.340 of 2018 registered for the offence under Sections 406, 420, 467, 468, 471, 120(B), 504 and 506 of the Indian Penal Code.

Allegation against the petitioner is that after taking consideration money the petitioner has mislead the informant/complainant with regard to the ownership of the land in question.

Learned counsel for the petitioner would submit that the earlier the land was registered and mutated in the name of the petitioner. The registry of the land was done in favour of

Patna High Court CR. MISC. No.23241 of 2020(2) dt.07-10-2020 2/2 the complainant/informant and it was mutated in the name of the complainant/informant after transfer of the land. Now the complainant/informant lodged the present case leveling imaginary, vague and bogus allegation against the petitioner. Considering the aforesaid facts and circumstances which primarily appears to be a case of civil nature, the Court is inclined to grant privilege of anticipatory bail to the petitioner. Let the petitioner, above named, in the event of arrest or surrender within a period of one month from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.

25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of 2nd Additional Chief Judicial Magistrate, Kaimur at Bhabhua in connection with Chainpur P.S. Case No.340 of 2018, subject to the condition that the petitioner shall not transfer any of his landed property standing in his name without prior permission of the court below and further subject to the conditions laid down under Section 438(2) Cr.P.C.
