2. Petitioner apprehends arrest in a case registered for the offence punishable under Section 40(1) of the Bihar Mining Act, Section 379/34 of the Indian Penal Code and Sections 33, 41 and 42 of the Indian Forest Act.

3 . Allegation against the petitioner is that he permitted the stone crusher machines to be operated from his field.

4. It is submitted on behalf of the petitioner that petitioner is innocent and has committed no offence as alleged. As a matter of fact, petitioner and his brother has their land appertaining to khata No. 117 plot No. 114 area 63.5 decimal under mauza Rudrapura . The total area of said plot No. 114 is very large and some persons had given there respective lands in plot No. 114 on rent to different persons for running crusher units but land of the petitioner was not being used for any such illegal activity and the same is not vacant land. There is house of petitioner over the said land and as such there is no question of running any crusher unit over the same . Petitioner claims clean antecedent. Similarly situated co-accused persons have already granted bail by this Court vide order dated 25.02.2025 in Cr. Misc. No. 12056 of 2025 .

5 . Learned counsel for the State opposes the bail petition of the petitioner.

6. Considering the aforesaid facts, clean antecedent of this petitioner and circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M.,
