The petitioner apprehends his arrest in connection with Kankarbagh P.S. Case no. 24 of 2017, registered under Sections 384, 504 and 506/34 of the Indian Penal Code.

The accusation is that in the evening of 11.01.2017, the informant was at Salimar Chowk, Kankarbagh, Patna at that time four unknown persons started to cause assault him making demand of Rs. One Lakh as ransom. At that time they also snatched cash of Rs. 20,000/- from the pocket of the informant and miscreants also asked to give Rs. 80,000/- otherwise he will face dire consequence. At that time, out of four persons, he identified the petitioner. It is alleged that earlier the petitioner used to reside in his mohalla Chandmari Road. The informant claimed to identify rest three culprits on seeing them again.

No.19998 of 2017 (3) dt.07-09-2017 2/2 Learned counsel for the petitioner submits that admittedly the petitioner used to reside on rent at Chandmari Road in the house of the informant. The petitioner has three vehicles, which were plied in MORTH Company, Ministry of Road Transport, Union of India and the informant also wanted to engage his vehicle in that department, but he could not succeed due to engagement of three vehicles of the petitioner, this case has been lodging making allegation of causing assault and demand of ransom to the informant by the petitioner and others. Further submission is that not a single witness has supported the prosecution case and there is no description of injury report of the informant in the case diary, which is up to paragraph 26.

Further submission is that petitioner has no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Patna in connection with Kankarbagh P.S. Case No. 24 of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
