The petitioner has preferred this application for grant of regular bail in a case registered under sections 413 and 414 of the Indian Penal Code.

As per the prosecution case, on a raid being conducted, it is stated that four accused persons including the petitioner herein as also accused Vikash Kumar Yadav and Rajnish Tiwary were caught while others managed to escape. Eight stolen motorcycles were recovered from their possession. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. He was arrested under a misunderstanding. He has no concern with the seized motorcycles. He is in custody since 6.1.2021 and has

Patna High Court CR. MISC. No.36936 of 2021(2) dt.07-01-2022 2/2 no criminal antecedent. His case stands on a similar footing to that of co-accused Vikash Kumar Yadav and Rajnish Tiwary who have been enlarged on bail vide order dated 23.12.2021 passed in Cr. Misc. no.32032 of 2021.

Having heard learned counsel for the parties and taking into consideration the facts of the case, the petitioner having remained in custody for 1 year and grant of bail to the above mentioned co-accused, the Court directs the petitioner to be enlarged on bail in connection with Raghunathpur P.S. Case no.5 of 2021 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate VIII, Siwan.
