JUSTICE DINESH KUMAR SINGH ORAL ORDER 04-01-2016 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 307, 324/34 of the Indian Penal Code and Section 27 of the Arms Act.

The prosecution case is that in the background of some land dispute co-accused Pappu Yadav caused fire arm injury to the informant. The petitioner was also member of the unlawful assembly.

It is submitted by learned counsel for the petitioner that for the occurrence of 08.11.2015 the F.I.R was registered on 11.11.2015 and there is no specific overt act alleged against the petitioner.

A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the delayed lodging of the case

Patna High Court Cr.Misc. No.58034 of 2015 (2) dt.04-01-2016 2/2 and the specific overt act alleged against co-accused Pappu Yadav, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Delha P.S. Case No. 230 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
