The petitioner apprehends his arrest in connection with Magadh University P.S. Case No. 40 of 2017, registered for the offences punishable under Sections 363, 365/34 of the Indian Penal Code Allegedly, co-accused Deepak Kumar kidnapped the daughter of the informant when she has gone for coaching and against the petitioner it is suspected that the petitioner has also assisted Deepak Kumar.
Submission is of false implication and that besides suspicion there is nothing against the petitioner, the petitioner has got no concerned with co-accused Deepak Kumar. Similarly
Patna High Court Cr.Misc. No.44471 of 2017 (2) dt.22-09-2017 2/2 situated co-accused Deosharan Manjhi has been allowed pre-arrest bail vide Cr. Misc. No. 38739 of 2017 by another co-ordinate bench of this Court and, as such, the petitioner deserves sympathetic consideration.
The learned A.P.P. fairly submits that the petitioner has also got no criminal antecedent.
In the facts and circumstances as stated above, the petitioner in the event of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IX, Gaya, in connection with Magadh University P.S. Case No. 40 of 2017, subject to the conditions as laid down in section 438(2) of the Cr.P.C.
