JUSTICE SHIVAJI PANDEY ORAL ORDER 22-09-2017 In this case, the petitioner is apprehending his arrest in connection with Rajauli P.S. Case No. 141 of 2017 registered for offence under Section 7 of the E.C. Act.
In the inspection, it was found that there was a shortage of grain and learned counsel for the petitioner submits that the petitioner is ready to deposit the value of the grain within a period of thirty days from today.
In view of the above, let the petitioner, namely, Surendra Kumar Chaudhary, in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Nawada in connection
Patna High Court Cr.Misc. No.41068 of 2017 (2) dt.22-09-2017 with Rajauli P.S. Case No. 141 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. It is made clear that if the petitioner fails to deposit the amount within the aforesaid period of thirty days from today, the privilege of anticipatory bail extended to him will be treated to have been withdrawn.
