====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 22-04-2019 Heard learned counsel for the petitioner and counsel appearing on behalf of the State.

The petitioner is in custody in connection with Kesharia P.S. Case No. 56 of 2019 for the offence under Sections 272, 273 of the I.P.C. and Section 30 (a), 37 (c) of Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. Learned counsel for the petitioner submits that in the instant total 123.840 ML liquor was seized. Learned counsel for the petitioner submits that petitioner is driver of the vehicle (Wagon R) wherefrom the alleged recovery was made. Learned counsel for the petitioner next contended that petitioner has no concern with the alleged recovered liquor. Learned counsel for the petitioner submits that

Considering the fact that the petitioner has no criminal antecedent, the Court is inclined to grant bail to the petitioner. Let the petitioner named above, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge 7th cum- Special Judge, Excise, East Champaran, Motihari in connection with Kesharia P.S. Case No. 56 of 2019.
