The petitioners apprehend their arrest in Narhat P.S. case No. 35 of 2017 under Section 366A/34 of the Indian Penal Code.

The father of the victim alleged that Vikash Kumar with the help of his father, Arun Rajbanshi, maternal uncle, Bachu Ram, petitioner No.1, maternal aunt, Urmila Devi, petitioner No.2 and maternal aunt, Bachia Devi, petitioner No.3, and others kidnapped his minor daughter for the purpose of marriage. The learned counsel for the petitioners submits that victim was in love with Vikash Kumar and both fled away from their house. The petitioners are maternal uncle and maternal aunts of Vikash Kumar. They have no manner of concern with the

Patna High Court Cr.Misc. No.11508 of 2018 (2) dt.05-03-2018 2/2 family affairs of Vikash Kumar and his father. Similarly situated accused Arun Rajbanshi and Sarju Ram have already been granted anticipatory/ regular bail respectively.

Taking into consideration the facts that petitioners are maternal uncle and maternal aunts of Vikash Kumar and the nature of allegation made against the petitioners, the petitioners, above named, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/ production of a copy of this order are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-III, Nawada in connection with Narhat P.S. case No. 35 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
