The petitioner has filed this application for bail in connection with Rajapakar (Baranti O.P.) P.S.Case No.197 of 2018 registered for the offence under sections 302 and 120B of the Indian Penal Code and section 27 of the Arms Act. The allegation as per the F.I.R. is that in the evening of the date of occurrence, the husband of the informant asked her to prepare kheer and said that he would come shortly. It is stated that after some time when he did not return, the informant and others started to search him and in course of search they saw six persons having assaulted her husband, running away. The petitioner is not named in the F.I.R.

Patna High Court CR. MISC. No.25201 of 2019(4) dt.31-08-2019 2/2 It is submitted on behalf of the petitioner that although the petitioner is known to the informant, he was not named in the F.I.R.. Further submission is that his name transpired in his own confessional statement made before the police. Besides the confessional statement there is no other material so as to connect him with the case and that he is in custody since 13.11.2018.It is further submitted that the investigation of the case has already concluded. Having heard learned counsel for the parties and taking into consideration the fact that the name of the petitioner has transpired on his confession made before the police, his period in custody and that the investigation in the case has concluded, this Court is inclined to enlarge the petitioner on bail.

Let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction to the Additional Chief Judicial Magistrate, VII, Vaishali at Hajipur, in Rajapakar (Baranti O.P.) P.S. Case No.197 of 2018.
