Counsel for the petitioners is directed to remove the defect(s), as pointed out by the office, within a period of four weeks from the date of restoration of normalcy. The petitioners are apprehending their arrest in connection with Murliganj P.S. case No.88/2020 registered under Sections 304(B)/34 of the Indian Penal Code. Allegation is that the accused persons including the petitioners caused death of the daughter of the informant due to non-fulfilment of demand of dowry.
It has been submitted on behalf of the petitioners that
Patna High Court CR. MISC. No.37404 of 2021(2) dt.17-08-2021 2/3 the petitioners have got no criminal antecedent and there is no allegation of tampering of witnesses alleged against the petitioners. The petitioners have falsely been implicated in this case. The petitioner No.1 is mother-in-law and petitioner No.2 is father-in-law of the deceased. They are separate in mess and property from the husband of the deceased. The husband of the deceased is in custody. After investigation, the police submitted final form against the petitioners, which is Annexure 2 to the present application. The court below differed with the said police report and had taken cognizance for the offence under Section 302 of I.P.C.
On behalf of the State, it is submitted that the petitioners are named in the complaint case/F.I.R. Considering the facts and circumstances of the case, the petitioners, above named, in the event of arrest or surrender before the learned court below within a period of twelve weeks from today, be released on anticipatory bail on their personal bond to the satisfaction of learned A.C.J.M.-11, Madhepura in connection with Murliganj P.S. case No.88/2020, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
Once the normalcy is restored, the petitioners will
