1. Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner seeks bail in connection with Palasi P.S. Case No. 327 of 2023 registered for the offences punishable under Sections 302, 201 and 34 of the Indian Penal Code.

The learned counsel for the petitioner submits that the instant regular bail application has been filed in terms of the liberty granted to the petitioner by an order dated 21.09.2024 in Criminal Miscellaneous No. 23916 of 2024. It is submitted that petitioner had earlier moved this Court seeking regular bail by filing Criminal Miscellaneous No. 23916 of 2024 which was rejected by an order dated 21.09.2024 with liberty to the petitioner to renew his prayer for bail after the informant

No.27847 of 2025(3) dt.02-05-2025 2/3 deposes in the trial, further liberty was granted to the petitioner that in the event if the informant does not depose in the trial within a period of six months from the order dated 21.09.2024 in that event also the petitioner would be at liberty to renew his prayer for bail.

4. The learned counsel for the petitioner next submits that a specific pleading has been made at Para-20 of the bail application that charges have been framed and the trial is going on, but till date the informant of the case has not deposed in the trial and period of six months has also expired.

5. Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Trial Court where the case is pending/successor court in connection with Palasi P.S. Case No. 327 of 2023.

7. However, it is made clear that the learned Trial Court before accepting the bail bonds of the petitioner shall verify that as to whether the informant had deposed in the trial

No.27847 of 2025(3) dt.02-05-2025 3/3 on or before 21.03.2025, if it is found that the informant deposed in the trial on or before 21.03.2025 in that event, the present order shall not be given effect to, but if it is found that the informant has not deposed in the trial or even if he has deposed but after 21.03.2025 in that event the bail bonds of the petitioner shall be accepted.

8. It is further made clear that if the learned Trial Court comes to a conclusion that petitioner, after his release, is trying to delay the trial in any manner in that event, the learned Trial Court shall be at liberty to cancel the bail bonds of the petitioner after recording reasons.

9. Accordingly, the instant regular bail application stands allowed.
