JUSTICE ANIL KUMAR SINHA ORAL ORDER 10-11-2020 Heard learned Counsel for the petitioner, learned Counsel for the informant and learned Additional Public Prosecutor representing the State, through Video Conferencing. The petitioner seeks regular bail in connection with Ishipur Barahat Police Station Case No. 49 of 2019, registered for the offences punishable under Sections 302/307/324/120B/34 of the Indian Penal Code. The allegation against the petitioner, as per the First Information Report, is that when the informant's son (deceased) was sleeping with his mother, the petitioner came and slit the throat of the son of the informant.

Learned Counsel for the petitioner submits that the petitioner has not committed any offence in the manner alleged

Patna High Court CR. MISC. No.27783 of 2020(2) dt.10-11-2020 2/2 and there is no eye-witness to the alleged killing. On the other hand, learned Counsel for the informant submits that there is categorical statement of the mother of the deceased that when she was sleeping with her son, the petitioner came and slit his throat.

After having heard learned Counsel for the parties and taking into consideration the materials on record, I am not inclined to grant bail to the petitioner.

This application is, accordingly, dismissed.

However, the petitioner may renew his prayer for bail after one year from today if the trial does not show any progress.
