The petitioner seeks pre-arrest bail in connection with Dalsinghsarai (Ghatho) P.S.Case No. 105 of 2017 registered under Sections 448, 341, 323, 324, 307, 379, 504, 506/34 of the Indian Penal Code and Section 8 of the Protection of Children from Sexual Offences Act.
It is contended by the learned counsel for the petitioner that the main allegation of assault is against Yoganand Jha, Pintu Jha and and Abhas Jha. He has submitted that so far as the petitioner is concerned, she is alleged to have assaulted the mother-in-law of the informant with lathi and danda along with one Abhas Jha. Learned counsel for the State has opposed the application for grant of pre-arrest bail.
Having considered the submissions made on behalf of the parties and the nature of allegation made against the petitioner, in the event of arrest or surrender before the court below within four weeks from today, he is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Dalsinghsarai, Samastipur in connection with Dalsinghsarai (Ghatho) P.S.Case No. 105 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
