2. Petitioners apprehend their arrest in a case registered for the offences punishable under Sections 108, 3(5) of the Bharatiya Nyaya Sanhita.

3. Prosecution case, in brief, is that daughter of the informant was married with co-accused Dhananjay Kumar in 2020 and out of the wedlock, a male child was born. In in the year 2022, son-in-law of the informant was killed in Ara for which F.I.R. was lodged and his daughter was living in her matrimonial house. It is alleged that the in-laws of daughter of informant used to torture and harass her for dowry of Rs. 2 lacs and due to the ill-behaviour of the in-laws, she committed

4. Learned counsel for the petitioner submits that petitioner No. 1 is Bhaisur whereas petitioner No. 2 is gotni of the deceased and they are separate in mess and property. It is submitted that there is general and omnibus allegation against these petitioners and after the death of the husband of deceased, there was no occasion for the accused persons to demand dowry. There is no material on record to demonstrate that their action instigated or drove the deceased to commit suicide. As a matter of fact, deceased committed suicide out of frustration and depression. F.I.R. has been lodged after inordinate delay of 18 days which itself raises doubt over veracity of the prosecution case. Petitioners claim clean antecedent.

5. Learned A.P.P. for the State vehemently opposed the bail application.

6. Considering the aforesaid facts and circumstances of the case, this anticipatory bail is allowed.

7. Let the above named petitioners in the event of their arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bailbond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief
