The petitioner is apprehending his arrest in connection with Khagaria (Chitragupta Nagar ) P.S.Case no.561 of 2018 G.R.No.2288 of 2018 , registered for offences punishable under Sections 420, 413, 379, 34 of the Indian Penal Code. Allegation as per FIR is that the informant provided maize to the agency of the petitioner, who is a commission agent for sending it to Hajipur and the same was sent by Truck No.DI. 1M 6508 through Driver, Manoj Kuamr Singh and he got the same measured also on M/S Siyalal Sah. Maa Kamakhya Dharma Kanta and he contacted with the Driver also till Hajipur. Later on the Driver informed that the goods were rejected by Godrej Agrover Pvt. Ltd. then he asked the Driver to bring it back but the Driver is also trace less along with the goods, as such he has misappropriated the whole maize in collusion with the petitioner.

No.26476 of 2019(2) dt.23-04-2019 2/2 Submission of the learned counsel for the petitioner is that he is only commission agent and according to the FIR, the truck has gone to Hajipur and thereafter he was traceless, as such he is not responsible and he is ready to co-operate in the investigation.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Khagaria in connection with Khagaria (Chitragupta Nagar) P.S.case No.561 of 2018, G.R.No.2288 of 2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure with further condition that he will co-operate in the investigation.

With the aforesaid observation, this application is allowed.
