1. Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner seeks bail in a case registered for the offences punishable under Sections 279, 336, 337, 338 and 304(a)34 of the Indian Penal Code as well as Sections 153 and 154 of the Railway Act.
3. Learned counsel for the petitioner submits that coaccused Anil Kumar had approached this Court seeking anticipatory bail by filing Cr. Misc. No. 27844 of 2024 and the same was allowed by an order dated 30.04.2024. It is further submitted that Anil Kumar is posted as Assistant Engineer with the railways and the petitioner is employed as track man. It is next submitted that the facts of the case have been dealt with in detail in Cr. Misc. No. 27844 of 2024. It is also submitted that
Patna High Court CR. MISC. No.29666 of 2024(3) dt.28-06-2024 2/2 Anil Kumar was granted the privilege of anticipatory bail and the petitioner is in custody since 12.02.2024.
4. Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.
5. Considering the aforesaid submissions, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Sonpur (Hajipur) Rail P.S.
