The petitioner apprehends his arrest in Excise case No. 316 of 2019, arising out of Sandesh P.S. case No. 31 of 2019, registered under Section 30(a) of the Bihar Prohibition & Excise Act.
The informant got information about illegal selling of country made liquor in mid of Sone riverbed. When the informant went there along with other police officials they saw many persons fleeing away. The Chowkidar is said to have identified and disclosed the name of petitioner. The learned counsel for the petitioner submits that petitioner is a farmer. There is nothing on record to show that petitioner was selling any liquor save and except the fact that petitioner was found fleeing away from the place of occurrence.

No.28434 of 2019(2) dt.30-04-2019 2/2 Considering the facts aforesaid and nature of allegation made against the petitioner, the petitioner, above named, in the event of his arrest/ surrender before the court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Bhojpur, Ara, in connection with Excise case No. 316 of 2019, arising out of Sandesh P.S. case No. 31 of 2019, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
