JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 11-09-2019 Heard learned counsel for the petitioner, the State and opposite party no.2.

The petitioner, who is husband of opposite party no.2, apprehends arrest in a case under sections 323 and 498A of the IPC and under sections 3⁄4 of the DP Act.

Learned counsel for the petitioner submits that in compliance of order dated 29.7.2019 passed by this Court the petitioner has brought back his wife to her matrimonial home at 9.8.2019 and the spouse is leading a happy conjugal life and supplementary affidavit to this effect has also been filed by the petitioner.

Learned counsel for the opposite party no.2 does not controvert this fact.

In view of the aforesaid development, the petitioner is

No.25178 of 2019(5) dt.11-09-2019 2/2 directed to be released on bail, in the event of his arrest/surrender within a period of six weeks from today, on his furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Katihar in Complaint Case being CA No. 1076 of 2018.
