The petitioner apprehends his arrest in connection with Banka (Mahila) P. S. Case No. 08 of 2017 registered for the offences punishable under Sections 341, 323, 354 (A), 354 (B), 504, 506/34 of the Indian Penal Code.
Allegedly, the petitioner and his friend Tinku Rajak brought the informant in a hotel where other co-accused were sitting and the petitioner tried to commit rape with her but due to alarm being raised the nearby persons assembled and then the accused persons fled away after causing threats. Submission is of false implication and that the prosecution story appears not probable and reliable and only with a view to extract money this case has been lodged by the informant and as
Patna High Court Cr.Misc. No.44280 of 2017(2) dt.21-09-2017 2/2 such the petitioner deserves sympathetic consideration. Learned APP opposes the prayer of pre-arrest bail. In the facts and circumstances stated above, the petitioner above named, in case of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order, is directed to be released on bail on execution of bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Smt. Kumari S. Kirty, J. M. Ist Class, Banka in connection with Banka (Mahila) P. S. Case No. 08 of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
