JUSTICE DINESH KUMAR SINGH ORAL ORDER 18-12-2015 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 376/511 of the Indian Penal Code.

The prosecution case is that petitioner entered into the room of the informant and outraged the modesty when he made an attempt to ravish the informant. On alarm being raised the mother and uncle of the informant came and caught the petitioner but subsequently the family members of the petitioner came and rescued him.

It is submitted by learned counsel for the petitioner that petitioner is next door neighbour of the informant and for a petty dispute the accusation has been levelled. No injury was either caused to the informant or the petitioner. Moreover the victim has not recorded her statement under Section 164 Cr.P.C nor she was medically been

A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioner surrenders within a period of six weeks in connection with Chiraiya P.S. Case No. 202 of 2015, pending in the Court of learned Additional Chief Judicial Magistrate, Sikrahana at Dhaka, East Champaran.

With the observations above, the application stands disposed off.
