2. The present intra Court appeal has been preferred against the order dated 29.03.2023 passed in C.W.J.C. No. 9536

Patna High Court L.P.A No.626 of 2023(6) dt.31-03-2026 2/2 of 2022. The appellant herein was respondent No. 5 before the Writ Court.

3. After some argument, learned counsel for the appellant seeks permission to withdraw the present appeal with liberty to pursue Title Suit No. 729 of 2022 which is pending for consideration before the Court of learned Sub Judge, Sasaram, Rohtas.

4. Permission is accorded.

5. Accordingly, the present appeal stands dismissed as withdrawn with the aforesaid liberty.

6. It goes without saying that the Court below shall take all necessary steps for expeditious disposal of the said Title Suit.

7. Pending application(s), if any, shall also stand disposed of.
