The petitioner seeks bail in Maner P.S. Case No. 35 of 2021, registered for the offence under Sections 364, 120(B), 34 of the Indian Penal Code.

As per the prosecution case, on 11.01.2021 at 4:30 PM, this petitioner alongwith co-accused Vishal Singh came at the house of informant and told that one Harendra Singh was calling her son at his Poultry Farm. Thereafter, son of the informant went with them, but he did not return till night. On the next day, when informant called on the mobile of this petitioner, he did not respond and switched off his mobile phone. Informant suspects that petitioner and co-accused have

It is submitted on behalf of petitioner that only suspicion has been raised against petitioner and during course of investigation, no cogent material has been collected to show his complicity in the aforesaid crime. It is further submitted that earlier, a case of kidnapping of minor girl was registered against the son of informant and a suspicion has been raised that family members of that minor girl might have killed him (informant's son). No motive has been attributed as to why this petitioner has committed the aforesaid crime and at best, it is a case 'last seen'. Petitioner claims clean antecedent and he is in custody since 21.01.2021.

However, learned A.P.P. for the State and learned counsel for the informant vehemently opposed the bail petition. It is submitted by learned counsel for the informant that son of the informant went with this petitioner and co-accused Vishal Singh and till date, the victim is traceless. It is further submitted that bail application of co-accused Vishal Singh has already been rejected by this Court.

Considering the aforesaid facts and circumstances as well as nature of allegation and the fact that bail application of

Patna High Court CR. MISC. No.36959 of 2021(5) dt.07-02-2022 3/3 similarly situated co-accused has already been rejected, I am not inclined to grant bail to the petitioner and same is, accordingly, rejected.
